Paddle Wars Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and CLMS Studio LLC ("CLMS Studio", "we", "us"), covering the Paddle Wars app for iOS and the services behind it. By downloading, creating an account in, or using Paddle Wars, you agree to these Terms. If you do not agree, do not use the app.
Paddle Wars turns real pickleball courts into Arenas you can claim, hold, and defend through geofenced, verified matches and ranked ladders. These Terms sit alongside the Paddle Wars Privacy Policy, which explains what we collect and why.
This agreement is with us, not Apple
These Terms are between you and CLMS Studio only — not with Apple. Apple is not a party to this agreement. CLMS Studio, not Apple, is solely responsible for Paddle Wars and its content.
Your licence to use Paddle Wars
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Paddle Wars on any Apple-branded product that you own or control, and as permitted by the Usage Rules set out in the App Store Terms of Service — including the Family Sharing and volume-purchase rules, where those apply. The licence covers use of the app itself; we keep all rights not expressly granted.
You may not:
- Copy, modify, translate, or create derivative works of the app, except where the law says you may
- Reverse engineer, decompile, or disassemble the app, or attempt to extract its source code
- Rent, lease, lend, sell, sublicense, or otherwise transfer your licence or your account
- Remove or obscure any copyright, trademark, or other proprietary notice
- Access the app or our servers by any means other than the interface we provide, or interfere with, overload, or probe the service
Accounts
Playing Paddle Wars requires an account with an email address and a password. You must be at least 13 years old. You agree to give accurate information, keep your password confidential, and tell us promptly at support@clmsstudio.com if you believe someone else is using your account. You are responsible for everything that happens under your account.
One account per person. Creating additional or shared accounts to manipulate ladders, ratings, or Arena claims is a breach of the fair-play rules below.
You can delete your account and its data at any time from inside the app: Settings → Delete account. Deleting your account does not cancel a subscription — see the subscription section below.
Paddle Wars Pro — subscription terms
Paddle Wars is free to download and play. Paddle Wars Pro is an optional auto-renewable subscription that unlocks additional features. Two options are offered:
- Paddle Wars Pro — Monthly: $7.99 per month, renewing every month
- Paddle Wars Pro — Annual: $59.99 per year, renewing every year
Prices are in US dollars. Prices in other App Store storefronts are set per that storefront and may differ; the exact price and billing period are always shown to you before you confirm the purchase.
Free trial. New subscribers get a 7-day free trial on either plan. The trial is available once per Apple ID and is for new subscribers only — if you have subscribed to Paddle Wars Pro before, you are not eligible. If you buy a subscription while a free trial is running, any unused portion of that free trial is forfeited.
Billing and renewal. Payment is charged to your Apple ID account when you confirm the purchase, or at the end of the free trial if you started with one. Your subscription renews automatically at the same price and period unless you cancel it at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the current period ends.
Cancelling and managing. You manage and cancel your subscription in your device's App Store account settings — iOS Settings → your name → Subscriptions — not inside Paddle Wars. Deleting the app, or deleting your Paddle Wars account, does not cancel the subscription; you must cancel through the App Store.
Refunds. Subscriptions are sold and processed by Apple. Refunds are handled by Apple under the App Store Terms of Service; CLMS Studio cannot issue refunds for App Store purchases.
Changes. We may change the price or what Pro includes. Any price change takes effect only at your next renewal, after Apple notifies you and — where required — you consent; you can always cancel before it applies.
When a subscription ends, Pro features stop. Your account, match history, and ratings remain unless you delete your account.
Maintenance and support
CLMS Studio is solely responsible for providing any maintenance and support services for Paddle Wars. Apple has no obligation whatsoever to furnish any maintenance or support services for the app. For help, email support@clmsstudio.com or see the Paddle Wars support page.
Warranty
Paddle Wars is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. CLMS Studio is solely responsible for any warranties — express or implied by law — that are not effectively disclaimed here.
In the event of any failure of Paddle Wars to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Paddle Wars.
Product claims
CLMS Studio, not Apple, is responsible for addressing any claims by you or any third party relating to Paddle Wars or your possession and use of it, including: (i) product-liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
Intellectual property
Paddle Wars — its name, design, artwork, code, ranking systems, and brand — belongs to CLMS Studio and is protected by copyright and other laws. Nothing in these Terms transfers ownership to you.
In the event of any third-party claim that Paddle Wars, or your possession and use of it, infringes that third party's intellectual property rights, CLMS Studio, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
Legal compliance
You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms and data
You must comply with any applicable third-party terms of agreement when using Paddle Wars — for example, your wireless carrier's data-plan terms and the App Store Terms of Service.
Court data. Arena locations are derived from OpenStreetMap. That data is © OpenStreetMap contributors and is made available under the Open Database License (ODbL). Your use of court data in Paddle Wars is subject to that licence. OpenStreetMap data is contributed by the public and may be incomplete, inaccurate, or out of date — a listed court may be private, closed, gated, seasonal, or require a fee or permit. Verify a court before you travel to it.
Paddle Wars also relies on services we do not control — including Apple's App Store and push-notification services and our backend host, Supabase — each subject to its own terms.
Apple as a third-party beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary of them.
Fair play
Paddle Wars only works if results are real. Matches are verified and geofenced, and ratings, ladders, and Arena holds depend on honest play. The following are prohibited:
- Falsifying or spoofing your location — GPS spoofing tools, modified or jailbroken devices, simulators, or any other method of appearing at a court you are not physically at
- Reporting matches that were not played, or reporting scores you know to be wrong
- Collusion — arranging results with another player to move ratings, hold an Arena, or farm wins
- Win farming — repeatedly playing throwaway matches, or using additional or shared accounts, to inflate a rating or claim count
- Harassing, threatening, or abusing other players, or filing knowingly false reports or disputes
- Automating play, using bots, or interfering with the app, our servers, or other players' use of the service
Where we believe these rules have been broken, we may — at our discretion and without notice — void matches, reverse rating changes, remove Arena claims, adjust or reset ladders, restrict features, and suspend or terminate accounts. Moderators may void a match or reverse a result while a dispute is investigated. Our decisions on match integrity are final.
Suspension or termination for breaking these rules does not entitle you to a refund of any subscription; App Store refunds remain a matter for Apple.
Content you submit
You keep ownership of the content you submit — your handle, display name, profile photo, team names and crests, and anything else you add. You grant CLMS Studio a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating Paddle Wars — for example, showing your handle on a leaderboard or your team's crest to its roster.
You agree not to submit content that:
- Is unlawful, hateful, harassing, threatening, obscene, or sexually explicit
- Impersonates another person, team, club, or organisation
- Infringes anyone's intellectual property, privacy, or other rights
- Contains other people's personal information, spam, or advertising
Content is moderated. You can report content and block players from within the app, and we review reports and act on objectionable content. We may remove any handle, display name, photo, team name, or crest, and suspend the account behind it, without notice. Content you make visible to other players — a handle, a team name, an Arena claim — is not private; don't put anything in it you wouldn't want other players to see.
Playing safely — physical activity
Pickleball is a physical sport, and physical activity carries a risk of injury. Consult a physician before starting or intensifying any exercise programme, particularly if you have a medical condition or have been inactive.
You play at your own risk and are solely responsible for your own safety. That includes assessing the court, its surface and surroundings, the weather, traffic, and the other people there; getting to and from a court safely; and deciding whether it is safe to play at all. Do not use Paddle Wars while driving, and do not let the app distract you from your surroundings. Obey local laws, posted hours, court rules, and private-property restrictions.
To the maximum extent permitted by law, CLMS Studio is not responsible for any injury, loss, or damage arising out of playing pickleball, travelling to or from a court, or interacting with other players.
No affiliation with courts or organisations
CLMS Studio is not affiliated with, endorsed by, or sponsored by any court owner, park authority, homeowners' association, school, club, league, tournament, or pickleball governing body. Arena names and locations come from public map data and do not imply permission to play, any right of access, or any relationship with whoever runs that court. Access, hours, fees, and rules are set entirely by them.
Availability and changes to the service
We may change, suspend, or discontinue any part of Paddle Wars — including features, Arenas, seasons, and ladders — and may reset ladders or seasons as part of normal play. We do not guarantee that the service will be uninterrupted, error-free, or available in any particular place. If we discontinue Paddle Wars entirely, we will give reasonable notice and stop charging for it.
Termination
You may stop using Paddle Wars at any time and delete your account from Settings → Delete account. We may suspend or terminate your access if you breach these Terms or if we are required to by law. On termination, your licence ends and you must stop using the app; the sections on intellectual property, warranty, product claims, liability, and governing law survive.
Limitation of liability
To the maximum extent permitted by applicable law, CLMS Studio is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of Paddle Wars — even if we have been advised of the possibility.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to Paddle Wars is limited to the greater of (a) the amount you paid us for Paddle Wars in the twelve months before the event giving rise to the claim, or (b) US $50.
Some jurisdictions do not allow certain exclusions or limitations, so parts of the two paragraphs above may not apply to you. Nothing in these Terms limits any rights you have under mandatory consumer-protection law in your country of residence, or our liability for death or personal injury caused by our negligence, or for fraud.
Privacy
What we collect, how we use it, what other players can see, and how to delete your data are all set out in the Paddle Wars Privacy Policy, which forms part of these Terms.
Governing law
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law rules. You and CLMS Studio agree to the exclusive jurisdiction of the state and federal courts located in Prince George's County, Maryland for any dispute arising out of these Terms, except where the law of your country of residence requires otherwise.
Changes to these terms
If these Terms change, the "Last updated" date at the top of this page will be revised, and the current version always lives at this URL. For material changes we will give notice in the app. Continuing to use Paddle Wars after a change means you accept the updated Terms.

Paddle Wars is published by CLMS Studio LLC, a Maryland limited liability company, of 3901 Dado Ct, Bowie, MD 20721, United States.
